The facts surrounding this settlement came about as a result of the National Automobile Dealers Association organizing a boycott, mandating inventory levels, soliciting certain types of agreements which halted invoice advertising, and dissuading business with automobile brokers.

This was a final judgment and order regarding the settlement between the United States and NADA. NADA was enjoined from having anything to do with any type of agreement that forces a car dealer to change or fix prices, or mandate that NADA’s members adopt a pricing system. The order also halted the NADA from instructing its dealers to refuse to do business with certain persons or groups, favor certain persons or groups, or change their business relations with certain persons or groups. The NADA was allowed to continue to disseminate information, represent their members in dealing with government and other organizations, gather data, and participate in dispute resolution. NADA was compelled to join into an antitrust compliance program.
